Legal Question in Family Law in Iowa
his rights
hello,
I am a German. I came over from Germany to the United Staates in August 2007. I was getting married with my husband in september 2007 in Amerika(Iowa). my husband is an American. before I came over to the USA, our child was born in Germany. he is the father of this child.
2 weeks ago, my husband told me, that he doesnt love me,also, he didnt marrie me, because of love and only made this marriage with me, because, he wanted to have our child here in the USA. I married him because I loved him.
I am still in a waiting process for my green card. Now I am waiting for it since 6 months. so, if I would leave America now with my child, I probably would never have the chance again to come back to Amerika.
my most important question is, if I would leave the USA with my child in the next days, what kind of rights could my husband have (because of our marriage) to take my child from me ( to hold in the USA).
Could this marriage also be unguilty, because he wanted to trick me and to catch me here with my child?
please help me!

Re: his rights
You need to contact a competent immigration attorney to secure your rights. A family law attorney can help you to file a petition to divorce this person, but you need to be a resident for a year with the intent to make Iowa your permanent home. Barring that you can petition the court for a custody and support order.
