Without having any more information than you have provided it is impossible to say. What was the RSO convicted of? Is it a repeat offense? Is there pedophilia involved? Violence? Are there other children in the neighborhood? Is the residence near a school or a park? What does Mom think about it? Are there custody issues? What is the position of the Department of Human Services on this matter?
