Legal Question in Family Law in Iowa

Shared custody support

I have shared cust. With my x. My son has decided he wants to live with mom full time. We had a arrangement that during the shared time she paid only the health ins for our son. Now she wants not to pay that since she has him full time. Shouldn't that remain the same since she was really only paying for ins. Even though it was worded as child support? And can he decide to live with her just because he doesn't like my rules?

Re: Shared custody support

You do not have to agree to change custody. Whether you would win or not depends on a lot of factors, including how old the child is. You need to consult a local family law attorney about this to best figure out the best thing to do in your situation.

Re: Shared custody support

With all due respect to counsel this is a matter of local law and practice and it is quite specific to Iowa.

What controls in this case is the custody and support agreement that you both were party to. Either party seeking a change must go to the court for it. It's also not a job for self help or amateurs. If your son is below the age of 18 he effectively doesn't get a vote as to where he lives.
