Legal Question in Family Law in Iowa

My son had 2 children with a woman that left him and took the children about 3 years ago. For a long time he got the children every other weekend. They have never gone to court over custody although he pays child support. This past year he has seen his children 4 times. When we ask her about having the children she responds with things like, "Its up to the kids" they are 5 and 6. My son has spoke to an attorney about it and knows that he has grounds to take her to court but needs $700.00 down to begin any process. He doesnt have that kind of money lying around and has other bills to pay as well. Is there something that can be done so he can see his children on a regular basis? Please help, as I know the longer she keeps his kids from him the more crap shes putting in their head about him. The Attorney he did talk to about this did go as far as to give her a call to see if the matter could be resolved out of court and she went off on the Attorney. He suggested going for full custody, but when he cant afford just setting up visitation rights how could he ever afford fighting for custody?

You answered your own question. "They never went to court over custody."

He's either got to hire an attorney somehow or give up.
