Legal Question in Family Law in Iowa
My step-daughter wrongly removed by social services
My stepdaughter has lived with her father and me for quite sometime...recently her mother has been investigated by social services for her other children, someone reported her for leaving the kids for days and using drugs...anyway in the second court hearing for this matter they said that they told us we had to take a drug test..,and they did, they just never said when..all is say's on our court papers is that we need to have one done, there is nothing in writing telling us when this is to be done by ...this was on a wednesday ,and not only did we feel we shouldn't have to do this we did not have the money it costed anyway...but when we got our check that following friday morning we went to take it anyway...well that same afternoon social services comes to my door to serve us some papers saying they are removing my stepdaughter because we where supposed to do the test on wednesday...we are in shock over this, now we have to do some mental health evualuation and i feel like prove our selves as parents and we have done nothing wrong here..our court appointed lawyer had even told us to take it whenever we got a chance..so my question would be,can they do this..there is nothing in writing saying we had to do the test that day or else.

You have a court appointed attorney. Best to find out exactly what it is you need to be doing. You can make the point at your next hearing.
