Legal Question in Family Law in Iowa

What to do about trouble from ex

My son has received full custody of his kids over 9 months ago. Since then their mother, his ex girlfriend has tried everything to get him thrown in jail over false accusations. He has succeeded in passing everything that they have put him through. She falsely accused him of sexual abuse of another child that was hers, not his. Then now she has accused him of doing drugs around them, when in fact she is the one that was testing positive at the birth of the second child and they merely slapped her hands and that was the end of that. What can we do to combat allthis that he gets accused of? No one wants to help him but they all listen to her till he proves the accusations wrong. Please advise us as what to do.

Re: What to do about trouble from ex

As a practical matter there is not really a lot that you can do about it. If this person swears out a false police report she can be prosecuted if it can be proved she knew the report was false at the time she filed it. Likewise if she makes a false statement under oath she can be prosecuted for perjury. There is the bare possibility of a civil action for slander or defamation but it is very difficult to prove, the cost mounts up with attorney's fees in excess of $100 per hour, and it is unlikely that you could ever recover any money from this person. One strategy is to put as much distance between you as possible and another is to have no contact with this person except through your lawyer....not answering her calls or blocking her calls will give you much peace of mind.
