Legal Question in Medical Leave in Iowa
I had an unforseeable medical leave. I work only weekends.I missed 3 consecutive days of work, 72 hours, making me eligible for FMLA. I had planned to go back after only missing 2 days, but my healing progress was not sufficient and I required a 3rd day. I notified my employer the third business day after returning. Thus far, I am being denied FMLA due to a "48 hour" notification window. I have worked for the company for 20+ years and have NEVER heard of this. Ironically, no one in my dept has either. It is stated NO WHERE in the employee handbook. Another employee in my dept suffered the same illness, missed the same time, and was granted family leave without hassle. I have not utilized FMLA for 7 years and do not have an attendance problem. I am in the midst of phone calls and an "appeals process". PLEASE HELP !!
