Legal Question in Civil Litigation in Iowa
My name is Andy. My brother's name is Michael. He has been in jail for a month now with a bail of $200,000. To my understanding 10%percent is needed. Based on what I know, he got into a fight with his girlfriend, who he lives with. Appearantly during the fight, they both had been drinking, she hit him in the nose and she has bite marks on her breasts. Her mother, who has a history of drug and alcohol abuse was also involved. According to Mike, the marks on his girlfriend came from her mother during their fight that night. The neighbor called the police and Michael was arrested. Appearantly his girlfriend decided that she does not want to press any charges after stating that he had been abusive towards her. While he is in jail, she still calls my family because they have a child together.
A few months before this she called the police on him and turned him in for driving without a license and insurance. He was arrested then, too. She tends get jealous of his son and seems to try to keep them apart by causing these kinds of problems.
Since she does not wish to press charges and her marks are soley her accusations, isn't his bail excessive and in violation of the 8th admendment?
