Legal Question in Civil Litigation in Iowa
Do payments given to a contractor before a contract is signed count toward services provided? There was an oral agreement on the work to be performed, backed-up by electronic mail correspondence. The original price was estimate, subject to change, but the contractor asked for a percentage to be paid to initiate the work and secure the business. A formal, written contract was later written but now the contractor is saying the money originally paid does not count toward the services performed since there was no signed contract.

But there was an oral contract and although more difficult to prove the oral contract is binding between the parties. It sounds as if you have your ducks in a row. The next job is to hire an attorney.
