Legal Question in Civil Litigation in Iowa
The person who baled my hay took it with out agreeing to a price. We had agreed to 1/2 was his for the labor, 1/2 would be mine to sell. He took it all. He tried to pay my wife but she denied payment not knowing how much to accept. A couple days later he had someone else drop off a check to my wife, again with no agreed price. I sent him a letter that disagreed with the price, told him what I wanted, but I did cash the check as partial payment. He is now claiming because I cashed the check, he will keep the hay and pay no more money. I feel cheated. I don't get my hay back or any more money as asked. Am I stuck, or can I proceed in small claims court? Thank you

You can proceed in small claims court but how will you prove how many bales of hay were cut? You need to get this man to first admit how many bales of hay there were.
