Legal Question in Civil Litigation in Iowa
Wrongful death
My 17 year old daughter got a ride with an 18 year old. The driver was 3 times the legal limit on alcohol. Daughter had no alchol in her system. The local paper says the alcohol was flushed out at the hospital. My daughter and the driver were killed in the accident. The medical examiner sayed that isn't possible. The driver died at the scene. My daughter spent 5hours insurgery before surcoming to her injuries. One passenger survived and was convicted of providing alcohol to minors. The owner of the vehicle was the parents of the driver. The insurance company has told me they use a mathematical model to determine my daughters net worth 3.8 GPA in high school. The auto insurance company has agreed to settle the case for $185,000 dollars. I don't trust the insurance company but everytime I talk to an attorny they immediatley want to take 1/3 of any settlement. Is $185,000 a resonable settlement? If I take an attorny at that rate after medical bills they will have pocketed more money than my family. Is there anything else that I should be concerned about?

Re: Wrongful death
Because this is a real situation and the insurance company could read my opinion I would rather you phoned my office and set up an appointment to discuss it with me. That will preserve your confidentiality.
