Legal Question in Health Care Law in Iowa

I am currently covered under my dads health care insurance. I am also 22.

I recently have found out that I am pregnant and had to make a trip to the ER yesterday due to a threatened miscarriage. As my boyfriend and I have not decided what we are doing as far as the pregnancy, I am reluctant to inform my parents just yet. I was told by several people that I would be able to call my insurance and just have the explanation of benefits (EOB) of my medical coverage use sent to me instead of my father. However, when I contacted the insurance provider today I was told that "the EOB cannot be mailed to anywhere except to the mailing correspondence on file" which is my parents home address in which I haven't lived for 4 years. Obviously, if my father receives the EOB in his name at his address he is going to open and read it. Which I was told again by the insurance provider that "since it's going to a secure location, it is considered satisfied by hiipa." I feel completely violated that I cannot control who has access to my EOB although I pay my co payments and bills after insurance. Do I have a case?

What kind of case do you think you have? There's no private right of action under HIPAA.

If you don't want your father ffinding out what you do with your boyfriend, you can always get your own unsurance.
