auto accident claim
my son and i were injured in a no-fault accident with a motorist who didnt have insurance , they cant determine who was at fault so i cant use my uninsured mortorist insurance on my policy.. the guy was on my left and i feel he needed to yeild to me,, my son face is scared from accident and my insurance co is dragging their feet in settling with me,, they just paid my medical bills from 4 months ago and i had 1,000.00 for medical and it got to the point where i was gonna be sued for these bills.. the other guy is a student and my insurance co needs to get his statement but he is giving them the run around and my ins. co is giving me the run around... what exactlly am i entitled to and my son was only the passenger so does my ins. co settle with him since he was scared??? thank-you michele

You have a conflict in settling your son's claim. You too may be a party for driving in a negligent manner. Your son's claim is viable as stated. Your insurance will provide coverage under the liability section and the UIM section. See a lawyer immediately.

I suggest you retain a lawyer familiar with auto accident law. Your son should be making an uninsured motorist claim and/or a claim against you.
