Unsure How to receive reasonable Compensation and my Rights

My husband, 7mo old daughter, dog, & myself were in a hit and run accident. My husband and myself are having back pain, & are receiving medical treatment. Daughter & dog appear to be okay. Our car was totaled. Driver has suspended license and fled the scene. We identified their car later that evening (they're neighbors) and confronted the people. Once found, the stepfather reported the accident before we could report that we located them. 3 hrs. after the accident, driver had high blood alcohol level, but within legal limits. Police believe he was probably drunk at time of accident. Have filed with insurance companies, etc. Car is insured by the driver's stepfather. Based in the information I am getting from the insurance companies, we will actually owe several thousand dollars to our car loan co. after an insurance payoff, and that's before our deductable's taken out. Our injuries have not been addressed, and haven't been determined to be long term at this point. Shouldn't we at least be able to get through this with some money to put towards another car? Does negligent entrustment have a part here? Will we be able to receive compensation for injuries, short term and/or long term? How do I go about this?

Hi,

You should file a claim with your own insurance company under the uninsured motorist section.
