Legal Question in Juvenile Dependency in Iowa
Mip
I am 17 and was at a house were there was a complaint for fighting. I didn't see the fight but before i had even got to the party i had drank 2 beers i was told to come out of the house and had to take a breath test even though the cops was there for another complaint. I blew a .030. I was taken to the clay county jail and awaked my parent. I was charged with a Minor in Possession even thought i had know alcohol. I was wondering how I could even get a possession if i was not caught with anything?

Re: Mip
If you fail the breath test it's pretty much conclusive evidence that you were in possession of alcohol.
