Legal Question in Employment Law in Iowa
made to work 80 hours because paid salary
I took a position as an outside salesman, being paid salary, I was told i would work M-F 8-5. A month later I was told i had to work 6-6pm. for the past 3 weeks I have had to work Saturdays in the warehouse. My job duties are not just outside sales, I am in the warehouse also. I worked 80 hours last week, after i completed my outside sales calls i was asked to work in the warehouse (weekdays), stocking shelves, counting parts, vacuming floors, helping customers. My job title is outside sales. In which I go to contractors selling HVAC equipment. I do have a degree and being asked to work blue collar. I feel that they are taking advantage of being paid salary. I am doing outside sales and also warehouse work, am i still considered exempt from the labor laws?
Thankyou, Phil

Re: made to work 80 hours because paid salary
It sounds like your employer is trying to get around the labor requirements here, by having an "outside salesman" do work that should be governed by the Fair Labor Standards Act. If you feel that you have a case, you should consult with a local attorney to determine waht your best options would be. If you think the problem is systemic, you may decide to start a class action on behalf of all employees. If it's just you, the strategy would be very different. If you can get documentation pertaining to your situation, do so, but don't go telling people what you're up to.
