Medical flex benefits
My husband's privately held company announced recently that they were being bought out by a publicly traded company. We have taken part in the company's medical flex benefit plan. This current year we have already submitted medical receipts for our entire allotment and the company has paid this out to us, even though we pay in weekly and our claims exceed what we have currently paid in. They have now informed us that when the sale of the company becomes final we must pay them back for the outstanding balance. Can they legally make us pay this back? If we did not use all the funds we had budgeted this year they would not have to pay us back.

Need to see the Purchase agreement and the Benefit plan to advise. This would be billable.
