Legal Question in Employment Law in Iowa

Termination, stated reason proven untrue.

I had worked for this major health insurance company for just less then two years. Had been promoted from Rep to Sales Manager within first year. Our district was producing at 65% of quota the first month I took over. When I was terminated we were at 135% of quota. The District Manager's has two operative viewpoints: information is power, therefore, keep it to yourself and the way to move up the corporate ladder is by not making waves or upsetting anyone in a position of authority.

With my hands on approach I was a threat to his job promotion. The bottom line here is that he found a reason he thought would work to replace me with someone he could better control. I travel in my job, both to work with my Reps and to open up potential markets for our product. I had gotten three speeding tickets, one of which I had plead not guilty to, as I was not guilty. The Iowa DOT mistakenly indicated in their computer data that my licence was under suspension. I provided the D.M. with proof that I had a license and HR also had proof of this fact, although they claim they did not. Iowa is a an ''at will state'', however, this company indicated a reason which was not a fact. They also have proceedures they have documented.

Re: Termination, stated reason proven untrue.

If the reason they terminated you was not true, it may be a basis for wrongful termination claim. Ask for the reason in writing.

Have you filed for unemployment insurance?

Have they asked for a severance waiver?
