Legal Question in Employment Law in Iowa

Wrongful Termination

An employee voluntarily makes an appointment with his employers contrated counseling service. The counselor concluded that the man was dangerous and at the point of being suicidal and homicidal to others. The counselor tells the mans boss and he is terminated and told to seek psychiatric treatment. The company grated him 2 weeks severance pay after being fired.

I understand it is wrongful termination. My question is, does the counselor have the right to discuss his pacients conditions to the employer?

Re: Wrongful Termination

If the counselor was a licensed medical or psychological professional, there was a clear breach of privacy, under state law and the Federal HIPPA statute.

Call or e-mail for further assistance.

There may be other remedies available.
