Tenant's Rights
Recently I had received an affidavit regarding a default by one of my landlord's partners in regards to bankruptcy. It stated that this landlord's partner owes money to some bank and if he doesn't pay that money, the apartment property will be confiscated. As a tenant, would I need to find a new apt? Would my landlords' problems affect my rights as a tenant? My lease isn't up until December 2007. My landlord recently sent us a letter regarding that the matter would be taken care of, but I don't know how much truth is in that. Is there anything I can do to cover my back?

I would need to review your lease re: termination and Bky provisions, if any, but you can be assured that as long as you are paying rent as agreed, you will be able to stay through Dec 2007, or beyond. Even if the current LL is out of the picture, the back/lender sees the tenants as the cash cows of the propoerty and won't evict paying tenants, even if they are trying to sell the building to new owners.
