Legal Question in Landlord & Tenant Law in Iowa
My toilet in my apartment complex has been defective since I moved in. It had been worked on several times and should have just been replaced in the beginning.
On February 22, 2011 ... the toilet was overflowing and wouldn't stop. I was trying to shut off the water, fell hit my head, passed out. When I woke up, I was bleeding from wounds and couldn't stop the bleeding.
I was taken to the hospital by ambulance and received stitches. I'm on SSDI and have no insurance at this time.
My apartment manager took an incident report and copies of all my bills and they HAD to replace my toilet. Evidently, when I fell from all the water on the floor, I fell into the tank and the toilet was pretty well busted up. Keep in mind, the toilet had to be replaced.
Do they have any liability on this matter? With the ambulance, emergency room and physician, my bills total about $2000.
Can you help me to know what I should do or what I can do, legally and within my rights as a Tenant.
Thanks ............

You should find out if they have an insurance company and what they'll pay for.
