Usually, a lawyer must not make a knowing misstatement of fact to anybody. Your question is overbroad.

Pete: Your question is too general for a good lawyer to answer. When the answer that first comes to mind is "Yes and no." then I know the question is too general and needs more specificity. What was said? When was it said? Was it said in briefs, in a trial, in pleadings, outside the courthouse or where? Who was it said to? Was it said to the Court, the media or some other person? How was it published? Was it published? If so to how many people?
