Legal Question in Medical Malpractice in Iowa

dental malpractice

When I was 10 or 11 I had some dental problems, i.e. I had an overbite and my parents had a local dentist look at me and he said he could correct the problem after the first dentist we went to said I needed to see an orthodontist. Now I have some serious problems and have been diagnosed with TMD. The orthodontist told me the main problem is from this dentist trying to correct the problems when he wasn't properly trained to do so. Now I'm 21 years old and in order to correct the problem it is very expensive and extensive. What are my rights? Do I have any?

Re: dental malpractice

Iowa Code section 614.1(9)(a) establishes the statute of limitations: There is a two-year statute of limitations on the filing of medical malpractice suits that runs from the discovery of the injury and also imposes a six-year absolute limit on such claims that runs, from the act causing the injury.

Therefore, you had until you were 17 years of age if this occurred when you were 11. I suggest you still contact a medical malpractice attorney in Iowa to see if there are any exceptions. I am sorry my information was not more positive.

Please be aware that my answer is not legal advice, it is merely information. You and I have not entered into an attorney/client relationship. The only way that I am legally responsible for your legal rights is if you have signed a written retainer agreement with my law firm.
