Legal Question in Medical Malpractice in Iowa
Malpractice Suit
I have had 3 right total knee replacements. The last one was in July of 2006. The first one was in 2001. I always had problems with the first knee they replaced, a little over a year later they did a revision. My knee was never right since the first surgery. The surgeon that did my last surgery...which was a senior partner in the same office as the dr. that did the first one said he could make it better. I was totally unaware til a month prior to my last surgery that my family dr. said the reason why my knee was not right is because they put in a larger prothesis then it should have been. I asked if I could have my old replacement knee back after surgery. I was told yes and a tech brought it into me and said,''I was told to get this to you immediately.'' It was in a plastic bag that new joints were sent in. The name of another patient, all her medical info was on a label on that bag...evidently she had a knee replaced that day. The hospital staff tried to take the joint fron me claiming it had the wrong name on it. My surgeon came in the next day stating he had my joint in his pickup and he would bring it in the next day. It mysreriously dissappeared...however I still have the one given me. Is there anything that can be done on this

Re: Malpractice Suit
Your situation is not unique or surprising. But the answer to the question posed is not so simple. You need to meet with a lawyer who could obtain your medical records, analyse them and then decide if there is any malpractice that can be proven. Call if you want such an appointment. Steve Lombardi
