Can a riding stable owner be sued by the family of a client or the client himself, who has signed a liability waiver, is killed or injured?

It's an interesting question and one we recently researched concerning an eleven year old girl who died on a ski slope. In this case the unrelated parent signed a liability waiver. The short answer:It can go either way. You should call for an appointment because the answer is fact driven. Some courts hold it is against public policy to allow an adult to waive liability for a minor concerning events that have yet to occur. As for adults there is a case involving buying a ticket to a hockey game and waiving liability holding liability is waived. I would need to know more. Steve Lombardi
