Legal Question in Personal Injury in Iowa
I signed a contract with our current sitter a very poor looking contract - I couldn't write a more unorganized one if I tried that states we need to give two weeks notice upon termination of childcare services. We have recently noticed signs of abuse physical and mental in our 13 month old twin daughters and are preparing to fire our provider. Do we really owe her two weeks of pay if we terminate her after signs of abuse? If she takes us to small claims court, who is going to win the case?

No lawyer can honestly answer this question without reviewing the contract, reading it, and knowing what facts support your claim of abuse. Impossibility is one defense to enforcement of a contract, but I think what you're saying is the babysitter, daycare provider, breached the contract, assuming she is allowing abuse of your children.
