Legal Question in Personal Injury in Iowa
Violation?
A couple girlfriends of mine and I were staying at a friend's. One of my friend's friends let us use his room to sleep. There was a hidden vidoe camera in the room that has a changing and doing other things in the room with out our permission. Several other friends of his have seen the movie. My friend doesn't know about the movie but all his friend's do and they are watching us. I can't get my hands on the video and they may or may not be chargin people to view the video. Is this something that can be taking to court if necessary? If so what kind of offenses will lthey be accounted for? If I chose to d take it to legal matters, how do I go about doing it? Can I press charges, if so how much could I possibly get from them?

The most obvious personal injury action which might result from this situation would be for a tort (or legal injury) known as 'invasion of privacy'. While not as well developed as some other areas of tort law, such as medical malpractice or car accident law, there are legal rights which courts have recognized which would apply in your situation. You have the right to privacy in terms of having freedom from uninvited videotaping of yourself in private, personal situations.
A motel employee in Eastern Iowa videotaped couples in motel rooms, and the motel was hit with a very large jury verdict. The person who viewed the videotape could also be found liable, but the ability of an attorney to get you a recovery for damages would hinge on the financial resources of the videotaper.
