Legal Question in Personal Injury in Iowa

Wrongful suit

I am being sued for causing an injury to a minor on a bike while I was in my car with my mother. My mother saw the girl fallen off her bike and asked me to help her since she was hurt and her parents were further away than we were. When the mother of the child arrived, on foot, I offered a ride to the hospital for the child and parent. Now I am being sued, the mother claims I caused the accident and injury to the child. I am innocent. Are there laws that defend me? Can I counter-sue the parent for falsely accusing me?

You should take the paperwork to your insurance company and have them provide you with a defense. As part of insurance coverage they will provide you with a free defense attorney--however, if you do not notify them and there is a judgment against you, the insurance company will refuse to pay it because of the non-notification.

Best you can do is to tell your insurance paid-for attorney and hope that the other side will not be able to prove their case.
