Legal Question in Real Estate Law in Iowa
How can a debt collection company continue to collect on a credit card debt that was charged off 09-30-01? The issuing bank closed 02-02-02. The debt collector got a judgement on this debt 11-07-07. This debt collector has garnished wages in 2007, 2009, 2011, 2013, and as of June 25, has garnished $1671 for 2014, The orignal balance due in 2001 was $2,337.90. At the time of the judgement-$3,735.35. Now they say the balance is $4,045.81 and they will do a partial release of this lien for $3,248.63. This is a short sale where the sellers, who are the debtors in this case, will not and cannot receive any money from this sale. What can we do??

Is not clear what your role is here, so making a suggestion as to what you can do is difficult. I know in many parts of Iowa (yes, I am licensed and practice in Iowa), it is um, "recommended" that people do not need to hire their own attorney to represent them in real estate transactions. This is one example of why that is terrible advice. Ignore them and hire a real estate attorney to represent you.
