Legal Question in Real Estate Law in Iowa
delay of sale forclosure
We recently made arrangements with our mortgage lender for a loan modification. However; 3 days before the agreement we served with a foreclosure notice. I want to know how to submit a demand for delay of sale.

Re: delay of sale forclosure
The demand needs to be filed in the court in which the foreclosure case was filed. All the delay of sale will do is delay the time between when the decree is entered and the date of the Sheriff's sale. It will not delay entry of a judgment against you. You might want an attorney to go over your closing documents, just in case the lender or closing agent did not do everything correctly.
