i really need to know what i need to do or how to answer a notice that i have received on our home mortgage. it is called 'NOTICE OF INTENT TO FILE WRITTEN APPLICATION FOR DEFAULT.
i have already answered to a notice that we are in a 'Home Affordable WOrkout plan' with State Farm who holds our mortgage to lower payments so we can get back on track. i really cannot believe that this has gotten as far as it has to foreclosure and that we do not want to lose our home at all.
the firm that has been sending the notices i have faxed to them all the files and documents that are being 'in review' at State Farm right now and since February of this year for a workout plan with State Farm. That was due to talking with the firm last week and they said it would be very beneficial for me to fax that info to them and still i receive this notice yesterday.
it states in the notice that i have 10 days from the date which was 7/14/2009 to take action required but i do not know what action to take
also in the notice is our names and not sure what 'undisputed statement of material facts' means.
i just want to be able to respond accurately to avoid further foreclosure action. our file is still in review and State Farm is very busy

The Notice you received is one of the last steps before the foreclosure judgment is entered. There appears to be a disconnect between your lender and attorneys handling the foreclosure, which is not surprising. You should contact an attorney in your area immediately.
