Can my separated husband take his name off our home with out going to court first, and how?

Sure. He would need to convey his interest to you with a deed. Please be aware that this will not remove him from the note or mortgage. I strongly recommend you have a real estate attorney assist you with this. If the deed is not prepared properly, it may cause you problems in the future.
