Legal Question in Real Estate Law in Iowa
How Can This Be Right?
I live in the state of Iowa. My husband and I recently looked at a house for rent 20 miles from where we are currently living now. We filled out the paperwork to rent this house on a one year lease. The guy that actually owns this house is in Florida for the military. So he has a woman taking care of the renting of the house. We received a phone call a few days later from this lady telling us that we got the house. All we had to do was send the guy in Flordia a check for rent for the first month and she would give us the keys to the house. I sent out the check for the first months rent today. The electricity, gas, phone and water have already been transferred to the house. I received a phone call from this guy this evening. He had called to tell us that he had rented the house out to someone else right from underneath us. Is there anything of the legal nature that we can do about this considering we were already told that the house was ours and we could move in this weekend as long as he had the check for rent and it was cleared? If not, how is this fair?

You have the basics of a lawsuit for breach of contract, get a lawyer and sue the cheater.
