Legal Question in Real Estate Law in Iowa

Possession of a vehicle.

My girlfriend and I just broke off our engagement. While engaged we traded in her old vehicle for a newer vehicle and she paid the $1000 down payment. But due to her bad credit we put the loan in my name. The vehicle is also on my insurance and it is registered in my name as well. The certificate of title has both our names on it. Do I have the legal right to take possession of the vehicle?

If the title is in both names, either party has a right to the vehicle. You need legal advice to protect your interest. The vehicle should not be on your insurnnce unless you agreed to pay for it. If there is an accident your insurance rates will go up. In addition if there is a default on the car loan your credit will be effected. I suggest that you try to negotiate to pay off the loan and transfer title. Your friend may have another "friend or relative" guarantee another loan to relieve you of any further liability. This matter must be resolved or your future credit will be in jeapody.
