Legal Question in Real Estate Law in Iowa

I recently hired a photobooth company to provide a photobooth for my wedding reception and the photobooth broke down early in the night. While the company has agreed to issue a full refund for the photobooth, it refuses to give me any of the photos that were taken while the booth was working properly. Our contract states that I would be provided with a "memory book" in which a copy of each picture taken would be placed with space for each guest to write a note to us as the couple. The company also refuses to give us this memory book. Does the company have the right to keep these pictures of individuals from my reception?

Without reviewing your contract, I can only make some guesses. Your contract also probably provides that you will pay them a certain amount of money. Since they are giving you a "full refund" essentially they are terminating the contract since they were unable to perform. Perhaps if you would agree to pay them part of what you agreed to pay, since they are only able to provide you with part of what they agreed to provide, you might be able to get the book you are wanting. The way your question is worded, it appears that you are asking them to provide you something for nothing essentially.
