Legal Question in Real Estate Law in Iowa

thank you for your response... Im not sure how or why anything in my question would indicate that the bank was kept in the dark about anything... All I knew is that I was in contract with the previous owner.... I disclosed that to the bank...........that is the extent of what I knew... I do know enough to know that I fulfilled my obligation to the bank when I let them know I was under contract. There was nothing misleading or criminal done on my part...........Thats why I termed it as a refinance... that alone would indicate to any lender that there is or at least should be a lien on the home. I do thank you for you time however.

You're still getting foreclosed on, and if you have not hired an attorney to defend you're likely to lose your house. You indicated there's a pending sheriff's sale which means that in all likelihood judgment was already rendered.
