Legal Question in Real Estate Law in Iowa

Selling property with a lien

Can I sell property if there is a lien against the property?

The property is valued less than the judgement against me. I am on social security disability and that is my only source of income.

Re: Selling property with a lien

You can, but I would be surprised if anyone would buy it, since the property would still be subject to that lien. You may be able to negotiate what is called a short sale with the judgment creditor. You may also be able to get a partial release, or a release of the lien only as to that particular property. We do this frequently, and we would be happy to assist you with this.
