Legal Question in Real Estate Law in Iowa

spouse's name not on real estate.

My husband and I purchased a home about 3 years ago. I would like to know, since it isn't mentioned in his will, if I would get the house if something happened to him. His will divides all assets equally with his 3 children and myself. Would the house be part of the assets, or since I am his wife, would I get possession of it? Thank you for any help

Re: spouse's name not on real estate.

Depends on how you took title, I.e if you took it in joint tenancy, by definition it automaticaly

goes to the surving joint tennant, regardless ofwhat the will may say, but if it is tennants in common, his half passes under the terms of the Last Will & Testament.
