Hi,
I was awarded the the house during my divorce in 2006. My question is, I did not refinance and my ex did not give me the quit claim deed as per the divorce decree. Up until last year I claimed the house for my taxes, and then last year, since my ex helped me out with the mortgage I allowed him to claim it.
Does he have any legal right to have the ability to claim the house this year unless I grant him the the right to do so since it was deemed my asset by the court, or does he have the right to claim it since his name is on the mortgage?
I am currently working on getting the quit claim deed and refinancing the home, which should have been done 6 years ago...hindsight is always 20/20....

I think the person who makes the payments gets the mortgage interest deduction.
