Legal Question in Traffic Law in Iowa

Bench Warrant and Bar Registration

Is it possible for me to not be allowed

to sit for the bar examination

because of a bench warrant that was

issued for me when I was in college

because my attorney and I

mistakenly failed to appear in court

over a speeding violation? My

attorney and I appeared in court and

took care of the fines immediately

after becoming aware of the bench

warrant.

Re: Bench Warrant and Bar Registration

If it's been a few years and you haven't made a habit out of such things and you are candid with the bar examiners and on your preliminary application about this entire contretemps I don't see it as a great hurdle.

It's also not an offense of moral turpitude either. Something on paper from your attorney explaining the facts and circumstances would help too. In addition any letters of reference from people who are familiar with your character, particularly members of the bar will assist.

Remember the line to take is contrite and deferential yet earnest. That's what will carry the day.

The best thing to do is to contact the commission and get an informal read on the subject.

I see you're in the neighborhood-feel free to call as I am in the local directory. If you're starting your studies at Drake let me know-I can give you an unvarnished view of my experiences there. I graduated in 1996.

Best of luck,-we've all got something we wish we'd rather not have done.
