car hit by uninsured motorist

I had liability insurance on a 1999 Suzuki Esteem and was hit by an uninsured motorist. She was found at fault for the accident and received a ticket and fine. I have no recourse with my insurance since I only had liability. She has agreed to pay $1500 to me in monthly payaments for the damage. (My car was totaled.) Do I need to have a legal form signed or can we both just sign a paper agreeing to this. She understands that if she does not pay me that I will take her to small claims and file for $2000. She is a young girl (18) so I am trying to work with her on this. Any advice?

Yes. Have her sign a confession of judgment that you will hold unless she fails to pay. That will save you the trouble of litigating if she defaults.
