Legal Question in Traffic Law in Iowa
My car was totaled by an allegedly stolen vehicle
My car was legally parked and was rear ended and totaled at 2:40 in the morning. Other driver left the truck that hit it at the scene. Then within a few minutes of the accident being reported the truck was called in as being stolen. that call to the police came from a house less than 2 blocks from the accident scene. The owner was found by police in that house. 2 months have gone by and he still maintains he doesn't know who was driving the truck. His insurance is investigating the accident now. I only had liability on my car. So do I have grounds for a suit against the owner even though he says he wasn't driving and doesn't know who was? There isn't anyone who believes his story. His insurance is saying that if he maintains it was stolen and they cannot prove otherwise my vehicle will not be covers by them.

I suppose you could sue the guy but if you can't prove he was driving your lawsuit won't be going anywhere either.
