Legal Question in Traffic Law in Iowa

Driving under suspension????

I was pulled over today (6/29/09) for a small speeding offense (he didn't write a ticket for it) and I was informed that my license had been suspended since March 09. I had NO IDEA. I had gotten three speeding tickets in a year but I had been informed that one would not count cause it was not considered a moving violation. The reason why I had not received any info about the suspension is because my address is not up to date with the DOT. The officer informed me that I am eligible to reinstate my license now. I have to appear in court on Aug 5 to find out if I am guilty of driving without a license. What do I do here? I NEED to be able to drive for work.

Re: Driving under suspension????

You can plead not guilty and ask for a trial. At that point the department will produce proof that they mailed you a notice of suspension. If your address was not up to date with the DOT that may be considered your problem and not theirs.

Were you cited for driving under suspension or driving without a license? It makes a difference.
