Legal Question in Traffic Law in Iowa

i got an owi 9 months ago and it got dirty in court because of the circumstances with the officier. In the end I got a plea deal with a complaint filed against the cop and that was that. A couple of days ago having to pick up food for my family I had to go drive to the store even though my license was barred. I walked in and who did i see to my surprise was the officier that arrested me 9 months ago. I got my food and started walking home because I had a feeling he was still around and he pulls up behind me while walking and told me i was under arrest for driving while barred and found my car and had it towed. He claims he saw me driving earlier which i know he didnt but my question is does he have to catch me in the act?
