Legal Question in Wills and Trusts in Iowa

Broke and Homeless

My 70 yearold mother sold her home 6 years ago and moved in with her deceased sisters husband for companionship and conveniance for both of them. She used the proceeds from the sale of the house to remodel his house. He told her that her name was on the will with his 4 kids to split the house if he dies. He now has terminal cancer and my mother is taking care of him at home with maybe 2 months left to live. She found out that her name is not on the will as stated. Can his kids kick her out and leave her nothing? She receives only $620.00 a month social security and she refuses to move in with me or my sister. What is her alternatives?

Re: Broke and Homeless

If she is not in the will, and not in title to the property, she is in a tough position. She may have to make a claim against the estate for the money she put into the house. If he is still mentally competent, it is not too late for him to revise his will. This would certainly be the safest and cheapest solution.
