Legal Question in Wills and Trusts in Iowa

Executer seeking revengne .

My mother passed away and my brother had a heart attack at her funeral and passed 3 weeks later. My mother will read ''her surviving children'' should share the estate equally. My sister is the executor, she and my brothers widow have never gotten along. Now I find out that a check I received from my mothers personal savings account and a small life insurance that my sister chose to divide ,prior to contacting an attorney. My brother, my self and my sister each received $1800.00. My sister choose to not list her as a benefactor. Are my brother or myself in any kind of trouble? Is my sister? She seems to be using her position as executer

to settle old scores with all of us.

It isn't clear from your post whether the estate is being settled in Iowa or Nebraska. The executor of the estate is required to provide a full accounting for the estate to all heirs. If they fail to do that, you may need to hire your own attorney to investigate or challenge the administration of the estate. The will and all papers related to administration of the estate should be on file with the court and available for you to examine at the courthouse.
