Execution of will

I would like to know if there is a time limit to the execution of a will in Iowa. Our attorney is saying it will take six months or more to execute my aunts will, even though her business and records are very well organised and quite sraight forward. Thanks

Ask your attorney to show you the statutory time periods that relate to the administration and probate of the estate. The six month period that you have been advised of may be perfectly reasonable.

Each state has different rules and laws that regulate the filings and time periods involved with estate administration. Moreover, there are practical factors involved such as when asset information and appraisals can be obtained.

If the estate is taxable, then you have the much longer time frame of the filing of the Form 706 Estate Tax Return and waiting for response from the IRS on that filing.

Where a business is involved, these factors are more complicated and the time periods involved will increase.
