Must a will be probated in Iowa by either the family or the attoney who wrote th

We believe my father wrote a will sometime in the last ten years. He is ill and appears to be dying. However, he has not informed anyone if there is a will or where it is located. Should we find it, must it be presented to the proper authority to be probated? My brother is running the family business with my father. He is not able to accept any property or $$ due to an bad credit history. If we do not notify anyone what will happen.

When a person cannot provide information regarding his will, contact his attorney. If that does not help, ask friends, clergy and his bank (as many banks have trust departments). Also, check to see if a will has been filed in probate court (as this may be done while the testator is living).

If the decedent lived in Iowa, contact an attorney in the county in which decedent resided. To find an attorney, contact the state's bar association for a referral.
