Legal Question in Workers Comp in Iowa
We have a lawyer representing my son on a workman's comp case. I understood the lawyer got 1/3 of the benefits my son got for his fee. The disability benefits amounted to $17,151.48 so far plus $1720.53 in interest. Can the lawyer take 1/3 of the interest or is he limited to the disability benefits only. He took 1/3 of the total amount. As an accountant, I feel the interest should have gone to my son and reported it on his income tax as that is not disability income--that is interest income.

It would depend on the language of the retainer agreement I think.
