Legal Question in Workers Comp in Iowa

work comp & insurance

I work in a union factory. I was put on work comp for shoulder surgery

recovery time is 3 to 6 months. One month after surgery I was laid off. I have my health insurance threw work. I was told I would still receive work comp benifits but my insurance would end. I thought that as long as you were on work comp that they could not cancel your insurance but could only make you pay the employees share until you were released by the doctor.

Re: work comp & insurance

Dear Sirs:

Workmen's compensation benefits will still apply even if a layoff occurs.

You may have other remedies however and should you wish to discuss, please call our office.

Many thanks,

The two types of insurances are not coordinated meaning they can cancel your health insurance while youre on workers compensation. There is nothing in the law that prohibits the employer from canceling health insurance when a worker is injured and off work. But your union contract may prohibit the health insurance from being cancelled. Contact your union representative.
